1. Acceptance of Terms

By accessing or using the Habyt website (habyt.io) or our applications (including app.habyt.io), provided by Serapath Integrative Health & Wellness Services, operated by Avigno Technologies LLC ("Habyt," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Service Description

Habyt provides educational lifestyle and stress-management guidance, including an AI-assisted stress assessment, a personalized action plan, digital tracking tools, and optional human coaching sessions. Our goal is to help you understand patterns in your stress, sleep, movement, and nutrition, and to give you practical steps to work on them.

3. Not Medical Advice

Habyt is not a healthcare provider. Our assessments, reports, action plans, and coaching (whether delivered by AI or by a human coach) are for educational and wellness purposes only. They do not constitute medical advice, diagnosis, or treatment, and using our services does not create a doctor-patient relationship or any other clinical relationship between you and Habyt, Avigno Technologies LLC, or any coach affiliated with us.

Always consult a qualified healthcare provider before making changes to your diet, exercise routine, sleep habits, medications, or supplements based on anything you read or receive through Habyt, and before starting or stopping any medication. Never disregard professional medical advice or delay seeking it because of something you encountered through our services.

If you are experiencing a medical emergency, call 911 (US) immediately. If you are in crisis or having thoughts of suicide or self-harm, call or text 988 (Suicide & Crisis Lifeline) or go to your nearest emergency room. Habyt is not equipped to respond to emergencies and does not monitor for them.

4. Eligibility

You must be at least 18 years old to create an account or use our services. By using Habyt, you represent and warrant that you meet this age requirement. Our services are not directed to, and we do not knowingly collect information from, anyone under 18.

5. Account Registration

To access our services, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

6. Subscriptions & Payment

Payments are processed securely through Stripe; we do not store your full payment card details. Our stress assessment is free. Paid coaching programs are billed as one-time program fees rather than recurring subscriptions unless stated otherwise at checkout. As of this writing, our entry paid offering is the Foundations Program ($250 for a 2-week program); current pricing and inclusions for all programs are listed on our Programs page and are subject to change. By purchasing a program, you agree to pay the listed price, provide valid payment information, and authorize us to charge the applicable fees.

All sales are final unless otherwise stated. Refund requests will be evaluated on a case-by-case basis within 14 days of purchase — email hello@serapath.me.

7. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our services
• Share your account credentials with others
• Submit false or misleading information
• Use our AI coaching features to seek diagnosis, treatment, or medication guidance

8. Intellectual Property

All content, features, and functionality on our website and applications — including text, graphics, logos, icons, audio, video, software, and the Serapath™ and Habyt™ trademarks — are owned by Avigno Technologies LLC and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

9. Termination

We may suspend or terminate your access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may stop using our services and request deletion of your account at any time (see our Privacy Policy).

10. Limitation of Liability

To the fullest extent permitted by law, Avigno Technologies LLC, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to health outcomes, loss of data, or any damages resulting from reliance on information provided through our services. Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Santa Clara County, California.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
